1. Acceptance of these terms

By accessing or using this website (the “Site”), you agree to be bound by these Terms of Use and our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Site. The Site is operated by Oculentis Medical Pvt. Ltd., 501-A, Pinnacle Corporate Park, 5th Floor. Nr. Trade Center, BKC, Bandra (E), Mumbai - 400051 India (“Oculentis”, “we”, “us”).

2. Intended audience — healthcare professionals only

2.1 This Site is intended for licensed healthcare professionals (ophthalmologists, eye surgeons, clinical staff, hospital procurement) and business partners (distributors, institutional buyers). It is not intended for patients or the general public.

2.2 By continuing to use this Site you confirm that you are a licensed medical practitioner or an authorised representative of a healthcare organisation or business.

2.3 Some jurisdictions restrict advertising of prescription medicines to healthcare professionals. Accessing professional content from a jurisdiction where such access by you is not permitted is at your own responsibility.

3. Informational and educational purpose — no medical advice

3.1 All content on this Site — including product descriptions, clinical summaries, blog articles, videos, and educational materials — is provided for general informational and educational purposes only. It does not constitute medical advice, diagnosis, treatment recommendations, or a substitute for the independent professional judgment of a qualified clinician.

3.2 Clinical decisions — including diagnosis, choice of therapy, dosing, and ongoing patient management — remain the sole responsibility of the treating healthcare professional, exercising independent judgment in light of the individual patient's circumstances.

3.3 Nothing on this Site creates a doctor–patient relationship.

4. Product information and regulatory status

4.1 Product information on this Site is a summary. The Instructions for Use (IFU), labelling, and packaging accompanying each product are the authoritative source for indications, contraindications, warnings, precautions, and directions for use. Always read and follow the current IFU before using any product. IFUs may be updated; the version supplied with the product prevails over any website copy.

4.2 Products shown on this Site are licensed by CDSCO/FDA-India for the Indian market. Statements about regulatory status refer to the Indian regulatory framework and do not imply registration, approval, or availability in any other country. Oculentis Medical supplies the Indian market only.

4.3 Product availability, specifications, and packaging may change without notice and may differ between states and supply channels within India.

4.4 Nothing on this Site is an offer to sell a product in a jurisdiction where its sale would be unlawful. Purchases are governed by separate commercial agreements.

5. No warranty on content

5.1 We work to keep Site content accurate and current, but we make no representations or warranties, express or implied, about the completeness, accuracy, reliability, or availability of any content, including clinical data summaries, market statistics, or third-party materials.

5.2 To the maximum extent permitted by law, the Site and its content are provided “as is” and “as available”.

6. Intellectual property

6.1 All content on this Site — including text, graphics, logos, product names, images, videos, downloads, and software — is owned by or licensed to Oculentis and is protected by Indian and international copyright, trademark, and other intellectual property laws.

6.2 You may view, download (where a download is offered, e.g., IFUs), and print content for your professional, non-commercial use, provided you do not modify it and retain all proprietary notices.

6.3 You may not, without our prior written consent: reproduce, republish, redistribute, sell, or commercially exploit Site content; use the Oculentis name or marks in a way that suggests endorsement; frame or mirror the Site; or scrape, crawl, or bulk-extract content (including for training machine-learning models).

6.4 Third-party marks (e.g., regulator names, certification bodies) belong to their respective owners; references are factual and do not imply endorsement by those parties.

7. Acceptable use

You agree not to: (a) use the Site unlawfully or to transmit false, misleading, or malicious content; (b) submit another person's personal data without authority, or patient-identifiable information through web forms; (c) attempt to breach Site security, probe vulnerabilities, or disrupt service; (d) use the Site to promote competing products; or (e) misrepresent your professional status. We may suspend or block access for violations.

8. Third-party links and content

Links to third-party websites (regulators, professional societies, social platforms) are provided for convenience. We do not control and are not responsible for their content or practices.

9. Limitation of liability

9.1 To the maximum extent permitted by applicable law, Oculentis, its directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, data, goodwill, or business opportunity, arising from or related to your use of (or inability to use) the Site or reliance on its content.

9.2 Our aggregate liability arising out of or relating to the Site shall not exceed the greater of (a) INR 10,000 or (b) the amount you paid us, if any, for access to the relevant content in the 12 months preceding the claim.

9.3 Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for death or personal injury caused by negligence, fraud, or statutory consumer rights that cannot lawfully be excluded under the Consumer Protection Act, 2019 (India).

9.4 Product liability for our products is governed by the terms of sale and applicable product liability law; nothing in these website terms limits any mandatory rights in respect of the products themselves.

10. Indemnity

You agree to indemnify and hold harmless Oculentis from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of the Site, or your submission of content to the Site in violation of law or third-party rights.

11. Privacy and data

Your use of the Site is also governed by our Privacy Policy and Cookie Policy. Do not submit patient-identifiable data through this Site.

12. Adverse events and product complaints

If you experience or become aware of an adverse event, product quality issue, or suspected malfunction involving any Oculentis product, you must report it via our adverse-event channel (our adverse-event form or pv@oculentismedical.com) — this obligation exists independently of these terms and cannot be waived.

13. Changes to the Site and to these terms

We may modify, suspend, or discontinue any part of the Site without notice, and may update these terms from time to time. The current version (with its effective date) will always be posted here; continued use after an update constitutes acceptance.

14. Governing law and jurisdiction

14.1 These terms are governed by the laws of India. Subject to Section 14.2, the courts of Mumbai, Maharashtra shall have exclusive jurisdiction over disputes arising from these terms or the Site.

14.2 Nothing in this Section deprives you of mandatory consumer protections, or of the jurisdiction of competent courts, under the laws of the country where you reside or access the Site, where those cannot lawfully be excluded by contract.
